Tomado del resumen: "El presente artículo aclaró que una base de datos conforme nuestra jurisprudencia nacional es un conjunto organizado de datos personales, su exploración debe garantizar el derecho a la intimidad, concretamente autodeterminación informática o habeas data. La ley 906 de 2.004 en su artículo 244 reguló el acceso a bases de datos cuando se haga necesario a llegar a las investigaciones informaciones que reposen allí. Únicamente se requiere orden a policía judicial y control previo cuando es abúsqueda selectiva implique el acceso a información confidencial, referida al indiciado o imputado o, incluso a la obtención de datos derivados del análisis cruzado de las mismas, una vez allegados los resultados procede un control posterior. La corte constitucional consideró que la información confidencia, hace alusión a la privada, que es aquella que contiene datos personales o impersonales, toda vez que se inserta dentro del derecho fundamental al habeas data.
