El libro pretende establecer los cimientos jurídicos de la negociación en el derecho internacional. En un primer momento, el escrito presenta la arquitectura general de los medios de solución de controversias internacionales; prestando particular atención al proceso contencioso entre Estados ante la corte internacional de Justicia (I). Acto seguido. se sugieren algunas precisiones teóricas sobre la naturaleza del sistema internacional, y el lugar de la negociación bajo la carta  de las Naciones Unidas (II). En Tercer lugar, se presentara el caso de estudio entre Bolivia contra Chile (III) para finalmente, establecer aquellas situaciones que darían origen a una obligación de negociar conforme al derecho internacional (IV).
