En un sistema jurídico determinado, el derecho nacional prevé órganos y procedimientos distintos para solucionar los problemas jurídicos. En el sistema jurídico peruano, uno de los tales órganos es el Tribunal Constitucional, y los procesos a través de los cuales resuelve los problemas jurídicos que se le presentan son el proceso de hábeas corpus, el proceso de amparo, el proceso de hábeas data, el proceso de cumplimiento, normalmente llamados procesos de libertad; así como los procesos de inconstitucionalidad y de conflicto de competencias, normalmente conocidos como procesos orgánicos.
El derecho constitucional vigente está conformado por las normas constitucionales estatuidas por el constituyente; y por las normas constitucionales que a ellas están adscriptas.
