Ein Mann steht acht Stunden vor einer Postfiliale und tragt ein Schild mit der Aufschrift: Ich habe Post gestohlen - dies ist meine Strafe. Er wurde von einem Richter zu einer sogenannten Shame Sanction verurteilt, einer Sanktionsform, die seit den 1980er Jahren in den USA verhangt wird. Intuitiv reagiert man auf derartige Szenarien ablehnend, weil sie demutigend wirken. Das Ziel der Arbeit besteht darin, diese intuitive Ablehnung uberzeugend zu begrunden. Die Arbeit untersucht zunachst die massgeblichen Faktoren fur das Aufkommen der Shame Sanctions. Dann werden die wichtigsten Grunde, die Befurworter und Gegner dieser Sanktionsform diskutiert und analysiert. Im dritten Teil wird eine eigene Begrundung fur die intuitive Ablehnung der Shame Sanctions entwickelt, die zum Ergebnis kommt, dass Shame Sanctions mit der in einer demokratischen Burgergesellschaft geltenden Anforderung, auch den Delinquenten in seiner Burgerrolle zu respektieren, unvereinbar sind.
